Epitomedical IP, LLC (“Vēdius,” “we,” or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy describes the types of information we may collect from you when you use the Vēdius mobile application (the “App”), how we use the information we collect, with whom we share it, how we protect it, and the choices we offer you regarding our collection and use of such information.
Please read this Privacy Policy carefully. By using the App, you agree to the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the App.
Types of Information We Collect
We receive and store any information you provide to us through the App or otherwise (for example, if you contact us by telephone). This information may include your name, email address, physical address, telephone number and any other information provided or made available to us through your creation of an account, use of the App or our services. Additionally, when you access the App using a mobile device, we may collect and process real-time information about your location and your mobile device, including the unique identifier for your device. Most mobile devices allow you to turn location services off via the device’s settings menu.
When you use the App, we may also use third-party analytics tools (such as Acuity Scheduling) that collect information about user traffic on the App. The information we may collect by automated means may include, but is not limited to, the following:
- information about the devices you use to access the Internet (such as the IP address and the type of the device, operating system, and web browser);
- dates, times and duration of uses of the App (including whether you are a repeat or first time user); and
- information on actions taken on the App (such as page views and App navigation patterns).
How We Use the Information We Collect
We may use the information you provide to us to:
- provide you with services you request;
- register you to receive emails or other information or materials you request;
- understand your needs and interests and tailor the App and our services accordingly;
- respond to your questions and comments and provide customer support;
- communicate with you about our services, offers, and promotions;
- operate, evaluate, and improve our business and the services we offer;
- enforce our Terms of Service and other agreements; and
- comply with applicable legal requirements and industry standards.
We may also combine the information we collect with publicly available information, and with that of other users of the App. For example, we may use your and other users’ non-identifiable, aggregated data to improve the services we offer, for statistical analysis, and for other business purposes.
We also may use the information you disclose to us in other ways for which we provide specific notice at the time of collection.
Information We Share
We may disclose aggregated information about our users without restriction. We may disclose personally-identifiable information you disclose to us to our subsidiaries and affiliates, or to contractors, and service providers to help us operate, provide, improve, understand, customize, support, and market our services. For example: we may provide personally-identifiable information to our service providers who help us bring you the services, such as scheduling functionality, payment processing or sending email updates. In connection with these operations, our service providers may have access to personally-identifiable information for a limited time. We also maintain personally identifiable information through an electronic medical records system provided by Caspio (as may be updated to a successor service provider from time-to-time). All such third parties are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
We may also disclose personal information to: (i) comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) enforce or apply our Terms of Service and other agreements; and/or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Vēdius, users of our App, or others.
We also reserve the right to transfer personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use personal information in a manner that is consistent with our Privacy Policy.
Payment Information
If you make a purchase on the App, we will collect your credit or debit card number, expiration date, and other payment details (collectively, “Payment Information”). We may provide Payment Information and other personal information to our third party payment processors in order to complete purchases made on the App. Pursuant to the “Information We Share” section above, our third party payment processors are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them. However, we are not responsible for our third party payment processors’ use of any Payment Information or other personal information they collect in connection with your transactions on the App.
Your Choices
We offer you the following choices about what information we collect from you and how we communicate with you:
Marketing Emails. If we have sent you a marketing email, you may choose not to receive additional marketing emails from us by following the unsubscribe instructions contained in each email.
Location. You can restrict Vēdius’s collection and use of real-time information about your mobile device’s location through your device’s privacy settings.
Web Analytics. You may be able to opt-out of the aggregation and analysis of data collected about you on our App by our web analytics vendor, currently Acuity Scheduling, and as may be updated to a successor service provider from time-to-time.
Vēdius’s Services. You may delete your Vēdius’s account at any time using our in-app “delete my account” feature. When you delete your Vēdius’s account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our services.
Accessing and Correcting Your Information
You can review and change personal information you disclose to us by logging into the App and visiting your account profile page. Subject to applicable law, you may have certain additional rights to request access to and receive information about the personal information you have disclosed to us, update and correct inaccuracies in such personal information, and have such personal information blocked or deleted, as appropriate. The App may contain links to other websites. We are not responsible for the privacy practices of other websites. We encourage users to be aware when they leave the App to read the privacy statements of other websites that collect personally identifiable information. This Privacy Policy applies only to information collected by Vēdius via the App.
Security
Vēdius has implemented reasonable physical, administrative and technical safeguards in an effort to protect the confidentiality, integrity and availability of your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note that no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of information is at your own risk. We are not responsible for circumvention of any App privacy settings or our security measures.
Protected Health Information (“PHI”)
Vēdius allows you to store certain of your personal health information in the App, including your name, contact information, demographics, and any other healthcare information that may be deemed to be “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Vēdius will take commercially reasonable precautions to secure your information and will not sell or share your PHI with anyone else, except with your health care provider and as permitted by law. Vēdius expressly disclaims any and all warranties implied or otherwise with respect to the security or permanence or any stored PHI. You agree that the preservation of your PHI is your sole responsibility and will not hold Vēdius responsible for your inability to access or preserve such information through the App.
Providers and Payors
Providers are health care professionals that provide health care services to you and certain providers may be affiliated with Vēdius. The App provides users ability to schedule appointments with health care providers (“Providers”). Additionally, the App provides users with the ability to exchange certain registration information with Providers. Vēdius may also allow you to submit and store the name of your insurance or benefit plan in the App, but, Vēdius does not provide any information regarding coverage available, health care costs, or Providers participating in your plan. You should contact your insurance carrier or plan administrator (“Payors”) for this information.
Vēdius is not responsible for, and shall have no liability in connection with, any transactions or disputes between you and Providers or Payors. If you have a dispute with a Provider or Payor, you agree to release Vēdius (and its employees and agents) from claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed (including actual, consequential and punitive damages), arising out of or in any way connected with the use of the App or such disputes.
Children Under the Age of 13
The App is not directed to, and Vēdius does not knowingly collect or solicit personal information from, children under the age of 13.
Processing of Personal Information
Our computer systems are currently based in the United States, so your personal information will be processed by us in the U.S. where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you create a user account with the App as a visitor from outside the United States, by using the App you agree to this Privacy Policy and you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection of that required in the European Union or certain other countries, and to the processing of that information as described in this Privacy Policy.
Changes to Our Privacy Policy
Vēdius reserves the right to update or change this Privacy Policy at any time. If we make a material change to our Privacy Policy, we will indicate on the App that our privacy practices have changed and will provide a link to the new policy. In the event we make a material change to how we use personal information you disclose to us, we will provide you with an opportunity to opt out of such new or different use. The date this Privacy Policy was last revised is at the top of this page. You are responsible for periodically reviewing the App and this Privacy Policy to check for any updates or changes.
